The Need for a Guardianship or Conservatorship

A guardianship may be required when an individual is incapacitated and unable to look after his or her physical needs or health care. In such cases, Oregon law allows for the appointment of a guardian to oversee living arrangements, health care decisions, and daily personal care.

A conservatorship is similar to a guardianship, but it is concerned with protecting someone's finances. If a person becomes unable to manage his or her own financial affairs and has not created a power of attorney appointing a third party to make financial decisions on his or her behalf, a conservatorship may be the proper solution.
